(What You Can and Can't Do On Your Account...)

You're free to put up anything with a genuine purpose that isn't illegal. Generally something that your parents / grandparents would accept / like.

Other than that, you are FORBIDDEN from putting any content that is related to the following: (If found, we will REMOVE THEM INSTANTLY and you will be banned from RAM Host)

Do any of the following if you want to get unconditionally banned forever:

Phishing of any entity, including, but not limited to: eBay, PayPal, banks, government agencies, etc. Phishing occurs when a scam artist creates a fake site that looks like it belongs to a company or other entity that is real and tricking the visitor into entering their personal information. Anything created with an intent to decieve, or any other malicious intent, is strictly forbidden.

Attempting to hack/crack into someone elses account This includes, but is not limited to, brute force or dictionary attacks via FTP, SSH, the Web Control Panel, or any other means of login; using this server as a launchpad to hack into another server, etc.

Intentionally Causing a Denial of Service We understand that web sites can be busy, but if a few IP addresses are requesting the same file every few seconds over and over again, or if you install a CGI scipt that does nothing but count to a very large number, then you will be put on notice.

Piracy, Copyright/Trademark,Patent Infringement, storing/using illegal files. Includes software/serials/cracks/scripts/warez. Do not use our service to infringe on someone elses copyright or intelectual property! No warez linking sites! No stealing! No leaking secrets! No replica sites (see the fishing/scam/fraud section).

ROMs and Emulators You may not upload ROMs and/or Emulators that contain copyrighted and/or proprietary data.

IRC - Internet Relay Chat
Shared Customers: Running any kind of IRC client/server is not allowed.

Pornography. Child Pornography: naked people under 18 years old; falls under the same category as "no illegal files!"

Be advised that adult pornographic material is allowed provided you have proper recordkeeping and otherwise are in full compliance with US law and is legal in Kansas City, MO where the server is located.

Having incorrect name or address filed on your account. For regulatory, accounting, and tax purposes we require accurate information about the geographic location of our customers. Resellers and agents may optionally use their clients' information directly (instead of their own).

Running Persistent Processes. If you execute a command that does not terminate after one hour, it will automatically be killed.
Also, processes that use a lot of CPU resources will be reniced to a much lower priority.

Q, Can I Host A Chat Rooms / IRC bot?
A. For performance and stability reasons no, you may not. Web Forums and shout boxes are not included in this and are fine with us.

Q. Can I Host BitTorrent Scripts, including, but not limited to: TorrentFlux, RapidLeech, etc?
A. These scripts download torrents to our servers, and then you download it to your computer. Don't use our servers for transferring files via peer-to-peer.

Q. Can I Host A BitTorrent Tracker, including, but not limited to: opentracker, BlogTorrent, PHPBTTracker+, etc?
A. Torrent Trackers are strictly forbidden due to their being extremely CPU and bandwidth intensive.

Q. Am I allowed to signup for more than 1 account?

A. No. If you register more then 1 account, all of them will be found and suspended. We enforce this to prevent people from taking advantage of our 30 day risk-free promotion. If you need more than one account because you are e.g. acting as a reseller of our services then please contact us and we can discuss it - we are very flexible.

Q. Am I allowed to use my account to store backup or other large files?

A. Yes, provided you don't exceed your disk usage or data transfer quotas, and provided the files don't violate these terms.

Q. Am I allowed to host an image hosting script (like imageshack.us, flickr.com, etc) where it allows my visitors to upload images?

A. Yes, though be advised the maximum size of POST requests (which are used for file uploads) is 10 MB.

Remember, there is no size limit for files you upload via FTP.

Remember, You are responsible for everything on your account (e.g you are responsible for what your users upload).

Q. Am I allowed to host an video hosting script (like youtube.com, etc) where it allows my visitors to upload videos?

A. No, running a youtube or clip-share like script is not allowed due to the overhead of re-encoding video files.

We have no problem if you upload and host video files, but using our server to re-encode / convert them is strictly prohibited.

Q. Am I allowed to use my site for money-making purposes?

A. Yes, as long as it doesn't involve selling something illegal or violate these terms.

Q. Am I allowed to host a script that sends a lot of email?

A. Somewhat. We cap all users with a outgoing email quota of 200 messages per hour.
You can, however, send as much email you want if you send it out via a 3rd party smtp server (like the one your isp provides) - we fully support that (e.g. you can open sockets).
Also, using this service to send unsolicited email (otherwise known as SPAM) is strictly prohibited and will result in account suspension.

Q. Am I allowed to host a proxy script like CGIProxy, PHPProxy, Glype, etc?

A. No, we don't permit web based proxy scripts of any kind hosted on our servers.

Q. Are porn/adult sites allowed?

A. With limitation, adult sites are allowed so long as they are in full compliance with US laws.

Child pornography is strictly forbidden. Do not store, transmit, create, or examine any pictures, realistic or not, of humans, anthropomorphic depictions of human-like creatures, or images suggesting humans that are under the age of 18 years in an either implied or actual pornographic picture.

Pornography and sex-related merchandising are permitted provided it is legal in the city of Kansas City, the state of Missouri and the country of the United States of America. This includes sites that may infer sexual content, or links to pornography elsewhere. Nude "art" is permitted.

Q. Is my personal info safe with you? Are you going to sell my contact information?

A. Your personal info is safe with us. Your privacy is respected. We will never sell your personal information (although you are free to sell it yourself - go ahead and post it all over your web site if you really want to). If you don't believe us, then don't bother signing up.

Q. Will my site ever get deleted?

A. Yes, if you break any of the above terms, your site will be suspended and you'll get an email warning you to fix the violation within 7 days. If you don't respond, account will be terminated permanently.

If you break the above terms during a free trial period your account will be terminated without notice.

Your site will also get terminated 7 days after failing to pay your bill. (We will suspend it the first day your bill is late for a week, and if not paid within a week your account will be terminated and all data associated with your account will be removed.)

Q. Do you have CPU resource quotas?

A. No we don't. Note that this does not apply to abusive scripts (such as a script that does nothing but count to a large number, which are forbidden). Note that any script or program you run will be reniced to lower priority if it uses too much cpu resource - this is to ensure stability.

Q. What languages do you allow / support?

A. Your web site can be in any language you want (multiple languages too).

RAM Host itself only supports English (this applies to, but is not limited to, things like support and the web based control panel). We don't speak anything else here.

"We", "us", "our", "RAM Hosting", "RAMHost.us", "RAM-Host.com", and "RAM Web Hosting" refers to RAM Host and the proprietor thereto.

"You", "account holder", "members", "client", "consumer", "customer", and "users" are the party or parties to whom this service is provided.

"This service" refers to the internet web hosting and all related services neccessary and proper in relation thereto provided by us as detailed in your product plan.

By becoming a client of RAM Host you agree to all of the above and following terms completely and without reservation:

1) You, as the account holder, accept full responsibility for the content on your web site, even if such content was not created or uploaded by you. Additionally you swear none of the pages on your site contain anything illegal, obscene, degrading or abusive to another person, including pages that promote hate group propaganda, child pornography, piracy, and other illegal activities in this juristiction.

2) You agree that we have the right to remove any and all pages / websites that we determine have violated any of these rules at any time without notice to you and can take against you whatever measures we deem appropriate, including legal action and disclosing information about you to law enforcement, government authorities, and other interested third parties we deem appropriate at our discretion.

3) Members agree to indemnify and hold us harmless for any loss, claim, damage and expenses (including reasonable attorneys' fees) arising from or in connection with the contents of any pages or of any chat or messages on a bulletin board found to be infringing or illegal.

4) To the fullest extent permissible by law, we exclude all liability with respect to accuracy, content or availability of information on our web site and members websites. The content is provided "as is" and without warranties of any kind, either expressed or implied.

5) We do not warrant that the function contained in the materials available on the network will be uninterrupted or error free, that defects will be corrected, or that the websites that make them available are free of viruses or other harmful components. RAM Host shall not be held liable for the actions of our members nor the content they upload and distribute using our system. We will eliminate harmful content and enforce these terms unto our users on a best effort basis.

6) Any merchandise products or services available to users or members from links from this web site may or may not be provided by third parties who are not necessarily affiliated or connected with us.

7) To the fullest extent possible by law, we exclude any and all liability under any and all circumstances (including negligence) for any special, consequential, and/or punitive damages that may result from the use of, or the inability to use, the service and/or materials on this or any of our sites. Applicable laws may not apply to all parties who access our web sites, in such cases we will enforce these terms to the fullest extent that law permits.

8) This service will be available, under normal circumstances, approximately 99.9% of the time. This is an estimate only, and actual uptime may be less due to (but not exclusively) an act of god, natural disaster, or circumstances beyond our control. Service uptime is by no means certain and as such we will not be held liable for the downtime of your site, whether intentional or not, nor will we be held liable for any losses incurred as a result of any interruption of this service. This service is provided to you for a reasonable fee in the hope that it will be useful, but without any warranty; without even the implied warranty of merchantability or fitness for a particular purpose.

9) You agree to abide by any and all laws applicable in the following juristiction: City of Kansas City, State of Missouri, Country of USA as that is where the server is located.

10) You agree to refrain from the following activities: distribute worms, trojans, or viruses, or commit or attempt to commit any denial of service attack against any computer, network, or individual; violate export controls on any software, copyright, or other intellectual property; forge email headers or TCP/IP packet headers or engage in spoofing; store, transmit, create, or examine any pictures, realistic or not, of humans, anthropomorphic depictions of human-like creatures, or images suggesting humans that are under the age of 18 years in an either implied or actual pornographic picture; distribute, or make available in any way to any party intellectual property that requires some method of authorization to sell or distribute, which you do not have; access, or attempt to access a computer or network resource that you are not authorized to access; send unsolicited commercial or bulk email to any party for any reason which may or may not result in a complaint; publish any material that is grossly offensive, including but not limited to, exploitation of children, blatant expressions of bigotry, hatred, harassment, defamation, or invasion of privacy. This includes material that defames, abuses, harasses or threatens any person or group; use the service in the commission of any crime that violates the laws of local, state, and federal government of the United States of America; piracy, hacking, cracking, phreaking, warez, pyrotechnics, exploitive software or text that educates or encourages this activity.

11) You are expressly forbidden from running network server daemons that bind to a port and listen for and respond to requests.

12) Refunds will not be given more than 45 days after payment has been made and processed, regardless of amount of payment or service term of payment - no exceptions. Otherwise, all refunds will be granted on a case-by-case basis and we reserve the right to refuse to provide a refund to you for any reason whatsoever. Also, all sales are final unless we have told you otherwise in writing, in your plan details, or we decide otherwise in your favor. If you violate these terms you will not be given a refund, even if we have indicated otherwise. Also, if we provide more than one hour of support to you in a given month you forfeit the right to a refund. No exceptions. The preceding only applies to payments processed via the PayPal or Google Checkout payment service - for all other methods of payment, including cash payments, all sales are final and no refunds will be given under any and all circumstances, even if we have indicated otherwise. Also, if our support staff spends more than one hour per month helping you then you forfiet the right to a refund.

13) Governing Law/Disputes: The argreement shall be governed by the laws of the State of Texas, exclusive of its choice of law principles, and the laws of the United States of America, as applicable. The Agreement shall not be governed by the United Nations Convention on the International Sale of Goods. Exclusive venue for all disputes arising out of or relating to the agreement shall be the State and Federal courts in Cooke County, Texas, and each party agrees not to dispute such personal jurisdiction and waives all objections thereto.

14) Sales Tax: residents of Texas are required to submit 8.25% sales tax. This tax will be taken out of your bill automatically - we will not explicitly charge you extra for it. We subtract minutes off your service invoice period instead.

15) Force Majeure: RAM Host and it's owners and operators shall not be in default of any obligation under the Agreement if the failure to perform the obligation is due to any event beyond our control, including, without limitation, significant failure of a portion of the power grid, significant failure of the Internet, natural disaster, war, riot, insurrection, epidemic, strikes or other organized labor action, terrorist activity, or other events of a magnitude or type for which precautions are not generally taken in the industry.

16) We reserve the right to refuse service to anyone for any reason. We further reserve the right to restrict, suspend, limit, or terminate the service provided to you at any time without notice at our sole descretion.

By signing up and using the service we provide you agree to adhere to the terms set forth herein at all times without exception of any kind unless granted in writing from the proprietor of RAM Host. By continuing to use our service, you also agree to abide by any changes to these terms, even if no notice is

We are not lawyers, so if any conflicting provisions exist the stricter version that favours us will prevail. Also, any provisions that conflict with applicable laws shall render that provision null and void, but the remaining provisions shall remain in full effect to the fullest extent possible by law.
