Terms of Service / Acceptable Use Policy / Service Level Agreement for all CDN (Content Distribution Network) hosting clients/customers of RAM Host

Do any of the following if you want to get unconditionally banned forever:

Phishing of any entity, including, but not limited to: eBay, PayPal, banks, government agencies, etc. Phishing occurs when a scam artist creates a fake site that looks like it belongs to a company or other entity that is real and tricking the visitor into entering their personal information. Anything created with an intent to deceive, or any other malicious intent, is strictly forbidden.

Intentionally Causing a Denial of Service We understand that web sites can be busy, but if a few IP addresses are requesting the same file every few seconds over and over again then you may be suspended.

Piracy, Copyright/Trademark,Patent Infringement, storing/using illegal files. Includes software/serials/cracks/scripts/warez. Do not use our service to infringe on someone elses copyright or intellectual property! No warez! No stealing! No leaking secrets! No replica sites (see the fishing/scam/fraud section).

Pornography. Child Pornography: naked people under 18 years old; falls under the same category as "no illegal files!"

Be advised that adult pornographic material is allowed provided you have proper record keeping and otherwise are in full compliance with US law.

Having incorrect name or address filed on your account. For regulatory, accounting, and tax purposes we require accurate information about the geographic location of our customers.

Q. Is there a file size limit?

A. We do not strictly have a file size limit however large files (100MB or larger) may not perform as well as smaller files. Our CDN service is optimized for many small files like pictures, short videos, small software downloads, etc.

Q. Am I allowed to use your CDN to serve files from an image hosting script (like imageshack.us, flickr.com, etc) where it allows my visitors to upload images?

A. Yes, this is fine.

Remember, you are responsible for everything on your account (including what users of your web site upload that subsequently is served through our CDN).

Q. Am I allowed to use your CDN to serve files from an video hosting script (like youtube.com, etc) where it allows my visitors to upload videos?

A. Yes, running a youtube or clip-share like script is fine.

Q. Am I allowed to use my site for money-making purposes?

A. Yes, as long as it doesn't involve selling something illegal or violate these terms.

Q. Are porn/adult sites allowed?

A. With limitation, adult sites are allowed so long as they are in full compliance with US laws.

Child pornography is strictly forbidden. Do not store, transmit, create, or examine any pictures, realistic or not, of humans, anthropomorphic depictions of human-like creatures, or images suggesting humans that are under the age of 18 years in an either implied or actual pornographic picture.

Pornography and sex-related merchandising are permitted provided it is legal in USA. This includes sites that may infer sexual content. Nude "art" is permitted.

Q. Is my personal info safe with you? Are you going to sell my contact information?

A. Your personal info is safe with us. Your privacy is respected. We will never sell your personal information (although you are free to sell it yourself - go ahead and post it all over your web site if you really want to). If you don't believe us, then don't bother signing up.

Q. Do you have disk usage quotas?

A. Our CDN service pulls files from your server and caches them in our CDN network. We do not limit the disk usage of our clients as we do not permanently store any of your content, but merely cache it on-demand as required.

Q. What languages do you allow / support?

A. Your web site can be in any language you want (multiple languages too).

RAM Host itself only supports English (this applies to, but is not limited to, things like support and the web based control panel). We don't speak anything else here.

"We", "us", "our", "RAM Hosting", "RAMHost.us", "RAM-Host.com", and "RAM Web Hosting" refers to RAM Host and the proprietor thereto.

"You", "account holder", "members", "client", "consumer", "customer", and "users" are the party or parties to whom this service is provided.

"This service" refers to the internet web hosting and all related services necessary and proper in relation thereto provided by us as detailed in your product plan.

By becoming a client of RAM Host you agree to all of the above and following terms completely and without reservation:

1) You, as the account holder, accept full responsibility for the contents that pass through our network/servers, even if such content was not created or uploaded by you. Additionally you swear none of your content contains anything illegal, obscene, degrading or abusive to another person, including pages that promote hate group propaganda, child pornography, piracy, and other illegal activities in this jurisdiction.

2) You agree that we have the right to remove any and all content from our servers/network that we determine have violated any of these rules at any time without notice to you and can take against you whatever measures we deem appropriate, including legal action and disclosing information about you to law enforcement, government authorities, and other interested third parties we deem appropriate at our discretion.

3) Members agree to indemnify and hold us harmless for any loss, claim, damage and expenses (including reasonable attorneys' fees) arising from or in connection with the contents of any pages or of any chat or messages on a bulletin board found to be infringing or illegal.

4) To the fullest extent permissible by law, we exclude all liability with respect to accuracy, content or availability of information on our web site and members websites. The content is provided "as is" and without warranties of any kind, either expressed or implied.

5) We do not warrant that the function contained in the materials available on the network will be uninterrupted or error free, that defects will be corrected, or that the websites that make them available are free of viruses or other harmful components. RAM Host shall not be held liable for the actions of our members nor the content they upload and distribute using our system. We will eliminate harmful content and enforce these terms unto our users on a best effort basis.

6) Any merchandise products or services available to users or members from links from this web site may or may not be provided by third parties who are not necessarily affiliated or connected with us.

7) To the fullest extent possible by law, we exclude any and all liability under any and all circumstances (including negligence) for any special, consequential, and/or punitive damages that may result from the use of, or the inability to use, the service and/or materials on this or any of our sites. Applicable laws may not apply to all parties who access our web sites, in such cases we will enforce these terms to the fullest extent that law permits.

8) This service will be available, under normal circumstances, approximately 99.9% of the time. This is an estimate only, and actual uptime may be less due to (but not exclusively) an act of god, natural disaster, or circumstances beyond our control. Service uptime is by no means certain and as such we will not be held liable for the downtime of your site, whether intentional or not, nor will we be held liable for any losses incurred as a result of any interruption of this service. This service is provided to you for a reasonable fee in the hope that it will be useful, but without any warranty; without even the implied warranty of merchantability or fitness for a particular purpose.

9) You agree to refrain from the following activities: distribute worms, trojans, or viruses, or commit or attempt to commit any denial of service attack against any computer, network, or individual; violate export controls on any software, copyright, or other intellectual property; forge email headers or TCP/IP packet headers or engage in spoofing; store, transmit, create, or examine any pictures, realistic or not, of humans, anthropomorphic depictions of human-like creatures, or images suggesting humans that are under the age of 18 years in an either implied or actual pornographic picture; distribute, or make available in any way to any party intellectual property that requires some method of authorization to sell or distribute, which you do not have; access, or attempt to access a computer or network resource that you are not authorized to access; send unsolicited commercial or bulk email to any party for any reason which may or may not result in a complaint; publish any material that is grossly offensive, including but not limited to, exploitation of children, blatant expressions of bigotry, hatred, harassment, defamation, or invasion of privacy. This includes material that defames, abuses, harasses or threatens any person or group; use the service in the commission of any crime that violates the laws of local, state, and federal government of the United States of America; piracy, hacking, cracking, phreaking, warez, pyrotechnics, exploitative software or text that educates or encourages this activity.

10) Refunds will not be given regardless of amount of payment or service term of payment - no exceptions. All sales are final. Refund requests may be ignored.

11) Billing Disputes/Chargebacks: If you threaten us with a chargeback, or you initiate a chargeback against us, your service will be suspended and/or terminated. If you initiate a chargeback against us a $25 administrative fee will be billed.

12) Governing Law/Disputes: The agreement shall be governed by the laws of the State of Texas, exclusive of its choice of law principles, and the laws of the United States of America, as applicable. The Agreement shall not be governed by the United Nations Convention on the International Sale of Goods. Exclusive venue for all disputes arising out of or relating to the agreement shall be the courts in Cooke County, Texas, and each party agrees not to dispute such personal jurisdiction and waives all objections thereto.

13) Sales Tax: residents of Texas are required to submit 8.25% sales tax. This tax will be taken out of your bill automatically - we will not explicitly charge you extra for it. We subtract minutes off your service invoice period instead.

14) Force Majeure: RAM Host and it's owners and operators shall not be in default of any obligation under the Agreement if the failure to perform the obligation is due to any event beyond our control, including, without limitation, significant failure of a portion of the power grid, significant failure of the Internet, natural disaster, war, riot, insurrection, epidemic, strikes or other organized labour action, terrorist activity, or other events of a magnitude or type for which precautions are not generally taken in the industry.

15) We reserve the right to refuse service to anyone for any reason. We further reserve the right to restrict, suspend, limit, or terminate the service provided to you at any time without notice at our sole discretion.

16) Restoration of Backups: If your site experiences data loss due to no fault of our own (including but not limited to: accidental deletion, self-caused site damage, and/or defaced websites caused by an insecure script) then a $5.99 restoration fee will be charged per account before we proceed with the restoration. The only exception to this is data loss that affects multiple accounts en mass such as data loss caused by hardware failure: in such cases no restoration fee will be applied.

17) Client-Initiated Account Termination: If you instruct us to cancel your account before it expires, we will not issue a partial refund based on your remaining account time. However, we will, on request, credit another account you have with us. Cancellation requests not submitted via the support system (eg: support ticket) may be ignored and non-immediate cancellation requests will be ignored unless multiple products are tied to the same invoice (if you want to cancel at the end of your billing cycle, simply disregard your subsequent bill and renewal notices). As all billing is prepaid, paying an outstanding invoice to continue service after requesting service cancelation will be treated as the customer no longer wanting to cancel their services with us and the service term will continue to renew.

18) Duration of Contract: These Terms of Service (the Contract) is valid for the same duration as your billing cycle. Renewal of service will renew your contractual agreement with our Terms of Service.

By signing up and using the service we provide you agree to adhere to the terms set forth herein at all times without exception of any kind unless granted in writing from the proprietor of RAM Host. By continuing to use our service, you also agree to abide by any changes to these terms, even if no notice is

We support your Freedom of Speech and expression; however we ask that you understand that a responsibility is associated with this right. These terms may be changed at any time without notice to you. You agree that all changes after your signup still fully apply to you; your continued use of this service constitutes agreement. It is your responsibility to check the terms of service often. We may attempt to inform you when these or any other terms change, but you should have no expectation of notification from us.

Any provisions that conflict with applicable laws shall render that provision null and void, but all the remaining provisions shall remain in full effect to the fullest extent possible by law.
